Two officers in Palestine, TX were called in to a local Applebee’s to investigate a theft that had previously occurred at a nearby Walmart.

James Bushey walked into Walmart where he shoplifted a case of beer. Loss Prevention reported the theft to local police, who then followed the suspect into a nearby Applebee’s. Sgt. Gabriel Green and Kaylynn Griffin found Bushey hiding in the restaurant’s restroom where they patiently waited for the suspect to wash his hands and calmly escort him outside.

The body cams of both officers were both on during the entire incident and recorded the events that were soon to follow (footage provided below).

Neither officer expected Bushey to pull out a gun once they were outside the restaurant. This left officers no choice but to protect themselves and shoot back at the suspect who was instantly killed.

It was later determined that Bushey’s gun was a BB gun designed to look like a 9 mm handgun.

Neither officers have been charged for the killing of Bushey after the body cam footage was released and the incident was determined to be self defense.
